In Willenberg v. Bramblett, Rick Righi represented a general contractor in flood litigation. Plaintiff homeowner, age 77, brought a claim against the general contractor for negligently elevating the construction pad of the adjoining property, which caused flooding to Plaintiff's residence. The flooding ultimately resulted in total loss of her residence and required demolition and full replacement. The plaintiff called a civil engineer expert who testified that the general contractor failed to design and construct adequate drainage on the adjacent property. Rick advanced the defense that Plaintiff's residence would have flooded regardless of the new construction. The jury was out for 45 minutes and found for the defendant contractor.
