What Is Mediation

Mediation is a type of alternative dispute resolution. It occurs in an informal setting where the involved parties and their attorneys meet with an independent, neutral negotiator (mediator). The ultimate goal of mediation is to resolve the case. Generally, mediators are experienced lawyers selected by agreement of the parties involved or appointed by the Court. You do not have to go through litigation before trying mediation. In fact, many contracts require mediation as a pre-requisite to litigation.
