The concept of mediation has been around for a long time, but it is only recently that the courts have more thoroughly embraced mediation and other alternative dispute resolution (ADR) methods. Our attorneys have been utilizing mediation for three decades, and we have seen the benefits firsthand. Mediation is particularly useful when dealing with complicated civil liability cases. The attorneys at Righi Fitch Law Group have helped clients resolve thousands of cases with the help of mediation.

What Is Mediation
Mediation is a type of alternative dispute resolution. It occurs in an informal setting where the involved parties and their attorneys meet with an independent, neutral negotiator (mediator). The ultimate goal of mediation is to resolve the case. Generally, mediators are experienced lawyers selected by agreement of the parties involved or appointed by the Court. You do not have to go through litigation before trying mediation. In fact, many contracts require mediation as a pre-requisite to litigation.
Mediation can be used to resolve a wide range of legal disputes, including:
- Bad faith & insurance coverage cases
- Construction site accident liability
- Cyber liability
- Personal injury cases
- Premises & habitational liability
- Product liability
- Professional liability
- Retail & hospitality liability
- Transportation & Trucking
Typically, when mediation is court-ordered, the case will be handled by a Judge Pro Tempore and will be at no cost to the involved parties. When mediation is sought privately, the mediator will be compensated by the parties engaging their services. As a process, mediation is a largely voluntary process, even when ordered by the court.
When to Schedule Mediation
More and more, people are turning to mediation in the early stages of a legal dispute. At Righi Fitch Law Group, our attorneys have been trained to focus on case evaluation early on. This allows us to assess your situation thoroughly and help you determine the best course of action for your case. Our commitment to early case evaluation lends itself well to recent trends in scheduling mediation sooner rather than later. When handled carefully, a case can be investigated, evaluated, and prepared for success at mediation before costly litigation is pursued.
Other benefits to pursuing mediation include:
- Both parties have their chance to tell their side and be heard
- Both parties are actively involved in resolving the dispute
- People tend to feel more satisfied by the outcome of a case that is mediated
- Mediation sessions are private
- Mediation can help mitigate the cost of litigation
Even if a case cannot be resolved through mediation initially, it is still a useful tool that can help move the case towards resolution. Mediation often highlights the key strengths and weaknesses of a case. Additionally, necessary discovery can be determined, and the case may even be resolved in a subsequent mediation session, or informally, before more expenses are incurred.
