Comparative Fault Win

In Sonanes v. Core Construction Services of Arizona, Inc. (CV2008-090796), Rick Righi and Chris Begeman represented Core Construction, the general contractor at Gilbert High School in a construction accident trial. The plaintiff was injured when she was crushed by bathroom partitions after falling off a ladder during construction clean-up. The plaintiff's counsel asked the jury for $1.6 million in compensatory damages. The jury unanimously awarded Plaintiff $150,000 compensatory damages, apportioning 90% of the fault to the Plaintiff resulting in the final award of $15,000. Prior to trial, Core Construction offered $37,500 in an offer of judgment in response to the Plaintiff's demand for $450,000. The court sanctioned Plaintiff and awarded Core its taxable costs and expert fees which means Plaintiff recovered nothing.
