Maricopa County employers answer to both the EEOC’s Phoenix District Office and the Arizona Attorney General’s Civil Rights Division. Understanding the legal framework behind a charge is the first step toward defending it effectively.

The statutes most frequently at issue:

  • Title VII of the Civil Rights Act of 1964 prohibits sex discrimination in hiring, firing, pay, job assignments, promotions, and other terms and conditions of employment for employers with 15 or more employees.
  • Arizona Civil Rights Act mirrors Title VII protections and, for sexual harassment claims, extends coverage to some smaller employers that fall below the federal threshold.
  • Bostock v. Clayton County (2020) established that Title VII’s prohibition on sex discrimination encompasses discrimination based on sexual orientation and gender identity. Arizona’s Civil Rights Division applies this interpretation to state enforcement.
  • The Equal Pay Act of 1963 separately prohibits pay disparities between employees of different sexes performing substantially equal work.
  • Related theories that frequently accompany sex discrimination claims include sex stereotyping, pregnancy discrimination under the Pregnancy Discrimination Act, hostile work environment, and retaliation.

An employee filing a Title VII sex discrimination charge in Arizona has 300 days from the discriminatory act to file with the EEOC. Those filing directly with the Arizona Civil Rights Division (ACRD) have 180 days. Because the EEOC and ACRD operate under a worksharing agreement, a charge filed with one is typically cross-filed with the other. Employers generally receive notice within 10 days of the filing.

From that point, the process moves on a schedule the employer doesn’t control. The EEOC may investigate, request documentation, seek mediation, or issue a right-to-sue letter. If the agency finds reasonable cause and conciliation fails, it may pursue litigation directly or authorize the employee to file suit. How an employer responds during this window, including how it drafts its Position Statement and manages document preservation, can shape downstream litigation exposure considerably.
