How Long Do I Have to File a Personal Injury Claim in Arizona?

According to the Arizona Revised Statutes section 12-542, the statute of limitations for personal injury cases in the state of Arizona is two years. The statute of limitations is a law which limits how long injury victims have to file a personal injury claim before they are no longer eligible to do so.

In other words, this means you have two years from the date you sustained your injuries to file a claim, or you will lose your right to file along with your right to recover compensation no matter how serious your injuries are. It’s important to note that there are exceptions that can change this time limit. The exceptions include:

  • If the injury victim was a minor at the time of the accident the two-year time period will begin once the claimant turns 18.
  • If the injury victim has a condition that qualifies them as legally mentally incapacitated the statute of limitations will end two years from the date they are declared mentally capable again.
  • If the alleged negligent party leaves the state of Arizona before the lawsuit can be filed the time limit will most likely be extended.
